1. ELIGIBILITY: The Breakstone’s Most Tired Person Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States, its territories, and the District of Columbia, who are 18 years of age or the age of majority in their state of residence. The following persons are not eligible to participate in the Sweepstakes: employees, officers and directors of Lactalis Heritage Dairy, Inc. (“Sponsor”), Brandmovers, Inc. d/b/a The A Team (“Administrator”), and each of their respective parents, subsidiaries, affiliates, advertising agencies or partners along with members of the immediate family (spouses, parents, children, and siblings and their spouses) or same household as such persons (whether related or not). The Sweepstakes is subject to all applicable federal, state, local laws and regulations and is void where prohibited by law. Sponsor reserves the right to verify the eligibility and all facts at any time, and entrants agree to cooperate in any verification process/request. The Sweepstakes begins on August 25, 2026, at 12:00:01 a.m. Central Standard Time (“CST”) and ends on September 10, 2026 at 11:59:59 p.m. CST (“Sweepstakes Period”).
2. HOW TO ENTER: During the Sweepstakes Period, visit Breakstones.com/AmericasMostTired (the “Website”), and complete the entry form, including and click “submit”. All fields must be completed. Incomplete submissions are void. Limit one (1) entry per person. Any attempt to enter more than once by any means, including, but not limited to, use of multiple identities, email addresses, accounts, or other means may result in disqualification from this and any other promotional offerings by Sponsor at Sponsor’s sole discretion. Use of any macro, bot, script or other automated means to submit entries is prohibited. No responsibility is assumed for lost, late, damaged, misdirected, illegible, incomplete, incorrect entries or other sweepstakes materials, all of which are void, or for errors due to computer malfunctions, software errors, transmission problems or interruptions in operations. Sponsor’s database computer is the official timekeeping device for the Sweepstakes. Proof of transmission is not proof of receipt. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address provided at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrant affirms and represents that they entered the Sweepstakes using their true and correct legal name as it appears on government‑issued identification, and not under any pseudonym, alias, nickname, or assumed identity. Entrant understands and agrees that use of any name other than their legal name will render the entry and any prize claim ineligible, and that any such misrepresentation shall constitute grounds for immediate disqualification at the Sponsor’s sole discretion.
3. SELECTION/NOTIFICATION OF WINNER: A random drawing will be held on or about September 21, 2026, from among all eligible entries received during the Sweepstakes Period. Entrants irrevocably agree to be bound by these Official Rules and by the decisions of the judges, which are final and binding in all respects. Potential winners will be notified using the contact information provided at the time of entry on or around the drawing date. Potential winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited by law) and/or other documents as Sponsor may reasonably require in order to claim his/her prize within two (2) days of notification attempt or prize will be forfeited. If the potential winner cannot be contacted or the notification is returned as undeliverable within five (5) days after the attempt, the prize may be forfeited, and an alternate winner may be selected.
Sponsor shall not be responsible for (i) the failure of a potential winner to receive Sponsor’s notification for any reason, or for the inability of such potential winner to return Sponsor’s message for any reason; (ii) failed, returned or misdirected notifications due to inaccurate information provided by participant; or (iii) responses to a winner’s notification which are lost, late, incomplete, illegible, unintelligible, misdirected, or otherwise not received, in whole or in part, by Sponsor. The potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Sponsor reserves the right to require the potential winners to show proof of identity prior to receiving any prize.
Winner is responsible for all applicable local, state and federal taxes. Sponsor will issue winners of prizes valued at $2,000 or over an IRS 1099 Tax Form, and winner agrees to fully cooperate in complying with applicable governmental reporting requirements. If requested by Sponsor, the potential winner will be required to complete, sign and return to Sponsor an IRS Form W-9 prior to receiving the prize. Failure to complete, sign and return a W-9 will result in the winner being disqualified, and in such case Sponsor may, in its sole discretion, select an alternate winner in a random drawing from remaining eligible entries.
4. PRIZE: One (1) Prize Winner will receive the $5,000 to be paid in the form of Visa Gift Cards. ARV: $5,000. Visa is not a sponsor of or in any way affiliated with the Sweepstakes. Visa Gift Card is not redeemable or exchangeable for cash and is subject to all terms and conditions of use as established by Card issuer. Card terms and conditions apply. Sponsor or Administrator are not responsible for lost or stolen prize.
Prize Winner is solely responsible for all applicable federal, state and local taxes, and any other costs or expenses not specifically set forth herein. No transferring of prize, prize substitution or cash equivalent of prize permitted by winner, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute any prize or prize component for an equal or greater value in the event an advertised prize becomes unavailable.
Sponsor will send the prize and/or prize-related materials by U.P.S., U.S.P.S., and/or email (as applicable and in Sponsor’s discretion) to the winner at the physical and/or email addresses provided by the applicable winner at the time of entry, as confirmed during the verification process, within thirty (30) days of Sponsor’s receipt and verification of the documents required by Sponsor to be completed and/or signed by the applicable winner. Sponsor shall not be responsible for delivery of any documents and/or the prize or prize-related materials and information provided that Sponsor addresses the documents and/or materials to the address provided by the applicable winner. Sponsor is not responsible for prize information or documents that are lost or misdelivered by the postal service or carrier.
5. ODDS: Odds of winning depend on the number of eligible entries received.
6. MISCELLANEOUS: All entries made through any robotic, automatic, mechanical, programmed, or similar entry duplication method are void. Sponsor is not responsible for any (a) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (b) telephone, computer, mobile device, hardware, software, programming or network malfunction or other technical failures or errors, or the failure to properly process entries; (c) communication disruption or other forces beyond the reasonable control of the Sponsor, including but not limited to disruption related to internet traffic, wireless networks, virus, bug or non-authorized intervention; or (d) damage caused by a computer or mobile device related virus or otherwise resulting to any computer or mobile device from such person’s participation in the Sweepstakes whether human, mechanical or electronic. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the end date, Sponsor will post a notice on the Website and, to the extent possible, winner will be selected from among all eligible entries unaffected by any error that were received as of the termination date. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption, or damage will be disqualified. Entries that contain errors, or are incomplete or received after the Sweepstakes Period, will not be accepted.
7. RELEASE OF LIABILITY, VENUE, AND GOVERNING LAW: By participating, you release Sponsor, Administrator and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of any Sweepstakes (“Sweepstakes Entities”) from any and against any and all injury, loss or damage, or any other causes of action or claims related to participation in any Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and each entrant agrees that the Sweepstakes Entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to any Sweepstakes and/or the awarding of any prize except as expressly provided in these Official Rules. By participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with any Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waive all rights to claim, punitive, exemplary, incidental or consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Official Rules and all disputes shall be governed by the internal laws of the State of Illinois, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the State of Illinois, and entrant expressly consent to the jurisdiction of said courts and waive any objection thereto. For New Jersey residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.
WARNING: ANY ATTEMPT BY AN ENTRANT, OR ANY OTHER PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES AND OTHER ASSOCIATES LEGAL COSTS) FROM ANY SUCH ENTRANT, OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO SEEKING CRIMINAL PROSECUTION.
8. DATA: As permitted by law and in accordance with these Official Rules, each participant agrees that Sponsor may use the information that participant provides in connection with the Sweepstakes for the purposes and within the context of the Sweepstakes (including providing the information to third parties for the purposes of administering the Sweepstakes and/or awarding a prize), for Sponsor’s internal purposes, and for any other purposes outlined in these Official Rules. In the event of a conflict between these Official Rules and Sponsor’s Privacy Policy available at https://breakstones.com/privacy-policy/, to the extent it applies, these Official Rules shall control.
9. SEVERABILITY: If any one or more provisions of these Official Rules are held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these Official Rules.
10. FORCE MAJEURE: The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, terrorism, fire, riot, earthquake, pandemic, public health emergency, actions of governmental authorities outside the control of Sponsor, or other force majeure event shall not be considered a breach of these Official Rules.
11. WINNER LIST: For the winner’s name, send a self-addressed, stamped envelope to: Breakstone’s Most Tired Person Sweepstakes Winner List, P.O. Box 1843, Montague, NJ 07827. Requests must be received no later than November 27, 2026.
